Topic: Can Forgiving House Rent be considered as Zakat?

Q My sister husband don't work. he is living on help by his brother and sisters for many years. i was also helping her through zakat. She has almost no jewelry. His kids study and fee is paid again by family she had 3 Marla normal house for around 25 lac which few months back to buy new house from the share from father property house if sold. but after many months it is unsold yet and she started living in my ground portion and i charge her reduced rent as its difficult to pay full rent. Now her husband has around 25 lacs in account but that don't fall in current Nisab due to huge increase in gold value. Every month the 25 lac amount is decreasing due to expenses. If all relative don't help her it will be not possible for her to meet house hold needs.
I want your thought that is she eligible for zakat, can i adjust the remaining amount of rent in my zakat payment. Can i still help her through zakat (mainly by giving grocery or cloths or any other way).

*Clarification:* Brother! your question is not clear. First you wrote that the house is worth 2.5 million (25 lakh) and has not yet been sold. Then later you wrote that your brother-in-law has 2.5 million rupees from that house in his account. Please clarify whether the house has been sold or not.
*Answer to Clarification:* Sorry the word sold was missed in typing... yes he sold the house that why he got 25 lac. But the father house is not yet been sold and due to that he is unable to purchase some new house.

aIt should be understood that a person who does not own 52.5 tolas of silver, or its value in gold, cash, business goods, or extra belongings apart from basic needs, is considered eligible (mustahiq) to receive Zakat.
Therefore, if your sister does not own wealth equal to or more than this nisab amount, it is permissible to give her Zakat. However, since your brother-in-law has 2.5 million rupees in cash, he is not eligible to receive Zakat, and it is not permissible to give Zakat to him.
It should also be kept in mind that for Zakat to be valid, the eligible person must be given full ownership and possession of the Zakat amount. Based on this, simply forgiving rent payment does not count as paying Zakat.
However, if you first give the Zakat money to the eligible person, and then he or she willingly gives that same money back to you as rent, then the Zakat will be valid.
In addition, Zakat can be given not only in cash, but also in the form of food items, clothing, or other goods.

لا يجوز دفع الزكاة إلى من يملك نصابا أي مال كان دنانير أو دراهم أو سوائم أو عروضا للتجارة أو لغير التجارة فاضلا عن حاجته في جميع السنة هكذا في الزاهدي والشرط أن يكون فاضلا عن حاجته الأصلية، وهي مسكنه، وأثاث مسكنه وثيابه وخادمه، ومركبه وسلاحه، ولا يشترط النماء إذ هو شرط وجوب الزكاة لا الحرمان كذا في الكافي. ويجوز دفعها إلى من يملك أقل من النصاب، وإن كان صحيحا مكتسبا كذا في الزاهدي. ولا يدفع إلى مملوك غني غير مكاتبه كذا في معراج الدراية.

وشرعا (تملیک) خرج الاباحۃ، فلو أطعم یتیما ناویاً الزکاۃ لایجزیہ الا اذا دفع الیہ المطعوم کما لو کساہ بشرط أن یعقل القبض الا اذا حکم علیہ بنفقتھم (جزٔمال) خرج المنفعۃ، فلو اسکن فقیرا دارہ سنۃ ناویا لایجز یہ (عینہ الشارع) وھو ربع عشر نصاب حولی۔

وامّا الذی یرجع الی المودّی فمنھا ان یکون مالاً متقوّما علی الاطلاق سواء کان منصوصاً علیہ اولا من جنس المال الذی وجبت فیہ الزکاۃ او من غیر جنسہ والاصل انّ کل مال یجوز التصدق بہ تطوعاً یجوز اداء الزکاۃ منہ ومالا فلا۔
