Topic: Swallowing food that has entered the throat due to a burp (belching) while in the state of fasting    (No-14686)

Q Mufti Sahab! While in the state of fasting if some food comes up from the stomach and enters the mouth, then goes back into the throat, does it affect the fast?ot?

aLet it be clear that if food or anything else comes up to the mouth due to a burp (belch) and then goes back into the stomach unintentionally, the fast remains valid. However, if food comes up to the mouth and then swallowed intentionally, the fast is deemed invalid and it becomes obligatory to perform qaza for that day’s fast.

الدر المختار مع رد المحتار: (بَابُ مَا يُفْسِدُ الصَّوْمَ وَ مَا لَا يُفْسِدُهُ الْفَسَادُ، 424/2، ط: سعید)
"وَإِنْ ذَرَعَهُ الْقَيْءُ وَخَرَجَ) وَلَمْ يَعُدْ (لَايُفْطِرُ مُطْلَقًا) مَلَأَ أَوْ لَا (فَإِنْ عَادَ) بِلَا صُنْعِهِ (وَ) لَوْ (هُوَ مِلْءُ الْفَمِ مَعَ تَذَكُّرِهِ لِلصَّوْمِ لَايَفْسُدُ) خِلَافًا لِلثَّانِي".
(قَوْلُهُ: لَايُفْسِدُ) أَيْ عِنْدَ مُحَمَّدٍ، وَهُوَ الصَّحِيحُ؛ لِعَدَمِ وُجُودِ الصُّنْعِ؛ وَلِعَدَمِ وُجُودِ صُورَةِ الْفِطْرِ، وَهُوَ الِابْتِلَاعُ وَكَذَا مَعْنَاهُ؛ لِأَنَّهُ لَايَتَغَذَّى بِهِ بَلْ النَّفْسُ تَعَافُهُ، بَحْرٌ".
