Topic: Ruling regarding a situation in which a person forgets their fast, eats or drinks something and then afterwards eats or drinks intentionally again   (No-15746)

Q My son is turning 15 this year, so we have decided to make him fast during this year’s Ramadan. He had only been fasting for 5 days when one day he forgot that he was fasting and ate or drank something. Afterwards, he intentionally ate or drank again thinking that his fast had already been broken. He told me about this later. What is the ruling for my son’s fast in this situation?

aIn the given situation, your son forgot that he was fasting and ate or drank. Later on, he intentionally ate or drank again, thinking that his fast had already been broken. His fast was indeed broken. As a result, your son must perform qaza for that day’s fast, but kaffarah is not necessary.

لم تجب الكفارة بإفطاره عمدا بعد أكله أو شربه أو جماعه ناسيا؛ لأنه ظن في موضع الاشتباه بالنظير، وهو الأكل عمدا؛ لأن الأكل مضاد للصوم ساهيا أو عامدا فأورث شبهة۔۔الخ

الهندية: (206/1، ط: دار الفکر)
لو أكل أو شرب أو جامع ناسيا وظن أن ذلك فطره فأكل متعمدا لا كفارة عليه، وإن علم أن صومه لا يفسد بالنسيان عند أبي حنيفة - رحمه الله تعالى - لا تلزمه هو الصحيح هكذا في الخلاصة.
