Topic: Ruling of Selling a land bought for a Masjid    (No-33457)

Q We have purchased a piece of land with a house on it, it has been made waqf, and have since established regular prayers there, intending it to serve as a Masjid. The value of the land has now significantly increased. Would it be permissible to sell a portion of this land in order to purchase another property for a Masjid elsewhere, while continuing to use the remaining part of the original land as a Masjid at this location?

aIn the mentioned scenario it must be noted that once a Masjid has been established on a piece of land, it remains designated as a mosque until the Day of Judgement and cannot be used for any other purpose. Therefore, it is not permissible to sell a portion of the land even in order to purchase another Masjid.

(قَوْلُهُ: وَلَوْ خَرِبَ مَا حَوْلَهُ) أَيْ وَلَوْ مَعَ بَقَائِهِ عَامِرًا وَكَذَا لَوْ خَرِبَ وَلَيْسَ لَهُ مَا يُعْمَرُ بِهِ وَقَدْ اسْتَغْنَى النَّاسُ عَنْهُ لِبِنَاءِ مَسْجِدٍ آخَرَ (قَوْلُهُ: عِنْدَ الْإِمَامِ وَالثَّانِي) فَلَا يَعُودُ مِيرَاثًا وَلَا يَجُوزُ نَقْلُهُ وَنَقْلُ مَالِهِ إلَى مَسْجِدٍ آخَرَ، سَوَاءٌ كَانُوا يُصَلُّونَ فِيهِ أَوْ لَا وَهُوَ الْفَتْوَى حَاوِي الْقُدْسِيِّ، وَأَكْثَرُ الْمَشَايِخِ عَلَيْهِ مُجْتَبَى وَهُوَ الْأَوْجَهُ فَتْحٌ. اه.

قَوْلُهُ وَلَوْ خَرِبَ مَا حَوْلَ الْمَسْجِدِ وَاسْتُغْنِيَ عَنْهُ) أَيْ اسْتَغْنَى عَنْ الصَّلَاةِ فِيهِ أَهْلُ تِلْكَ الْمَحَلَّةِ أَوْ الْقَرْيَةِ بِأَنْ كَانَ فِي قَرْيَةٍ فَخَرِبَتْ وَحُوِّلَتْ مَزَارِعَ يَبْقَى مَسْجِدًا عَلَى حَالِهِ عِنْدَ أَبِي يُوسُفَ، وَهُوَ قَوْلُ أَبِي حَنِيفَةَ وَمَالِكٍ وَالشَّافِعِيِّ.
