Topic: Ruling on Constructing an Imam’s House on the Original Mosque Land    (No-27083)

Q Respected Teacher, Assalamu Alaikum wa Rahmatullahi wa Barakatuh,
We are in the process of expanding the mosque. The area where the mosque was originally built is now being considered—would it be permissible to construct a house for the Imam on that spot?

aIt should be noted that once a mosque has been established on a piece of land, it remains designated as a mosque until the Day of Judgement and cannot be used for any other purpose. Therefore, it is not permissible to construct the Imam’s house on the exact site where the mosque originally stood. However, if the land allocated for the mosque includes additional space beyond the actual mosque structure, then it would be permissible to build the Imam’s house in that extra area.

مَطْلَبٌ فِيمَا لَوْ خَرِبَ الْمَسْجِدُ أَوْ غَيْرُهُ (قَوْلُهُ: وَلَوْ خَرِبَ مَا حَوْلَهُ) أَيْ وَلَوْ مَعَ بَقَائِهِ عَامِرًا وَكَذَا لَوْ خَرِبَ وَلَيْسَ لَهُ مَا يُعْمَرُ بِهِ وَقَدْ اسْتَغْنَى النَّاسُ عَنْهُ لِبِنَاءِ مَسْجِدٍ آخَرَ (قَوْلُهُ: عِنْدَ الْإِمَامِ وَالثَّانِي) فَلَا يَعُودُ مِيرَاثًا وَلَا يَجُوزُ نَقْلُهُ وَنَقْلُ مَالِهِ إلَى مَسْجِدٍ آخَرَ، سَوَاءٌ كَانُوا يُصَلُّونَ فِيهِ أَوْ لَا وَهُوَ الْفَتْوَى حَاوِي الْقُدْسِيِّ، وَأَكْثَرُ الْمَشَايِخِ عَلَيْهِ مُجْتَبَى وَهُوَ الْأَوْجَهُ فَتْحٌ. اه

(قَوْلُهُ وَلَوْ خَرِبَ مَا حَوْلَ الْمَسْجِدِ وَاسْتُغْنِيَ عَنْهُ) أَيْ اسْتَغْنَى عَنْ الصَّلَاةِ فِيهِ أَهْلُ تِلْكَ الْمَحَلَّةِ أَوْ الْقَرْيَةِ بِأَنْ كَانَ فِي قَرْيَةٍ فَخَرِبَتْ وَحُوِّلَتْ مَزَارِعَ يَبْقَى مَسْجِدًا عَلَى حَالِهِ عِنْدَ أَبِي يُوسُفَ، وَهُوَ قَوْلُ أَبِي حَنِيفَةَ وَمَالِكٍ وَالشَّافِعِيِّ
