Topic: Ruling on praying behind the imam who wipes (Masah) on socks made of cloth or wool   (No-2713)

Q Mufti Sb my question is very detailed with different aspects. It is a very important issue that many people encountered in Pakistan, India and Bangladesh as well as abroad.
The issue is that, in the winter in United States, Imams wipe (Masah) on socks made of cloth or wool and justify this practice.
1. We go to a masjid for prayer with Jammat and see that Imam Sahib is wearing socks, but it is not known whether he would have washed his feet or wiped on his socks.
2. Sometimes it is seen that some local people of the masjid begin to lead prayers in the absence of Imam Sahib, and they too do wipe on socks either they agree with this practice or just saw Imam sb for wiping so they too do wiping without proper understanding.
Now even in this case, the present Imam is not seen performing ablution. In the first case, we participate in initiation or intercession in congregation prayer. Will our prayers be correct or will we have to repeat?
Now I want to point to another issue of the same question. That is, for non-locals who have come to this masjid because of any preaching (tableegh) purposes or meeting their relatives, they are praying in this masjid during a short stay in the area. What is the ruling for them? And what is the ruling for the permanent residents there?

aSocks that are made of full leather are called “Khuffain” or have leather on both the top and bottom, are called “Mujalladain” or have leather on the bottom only are called “Muna'allain”. It is permissible to do wipe over these three types (Khuffain, Mujalladain and Muna'allain).
Therefore, socks in which the following three characteristics are met:
1. Thick, not transparent, i.e; if water is poured on them, it will not reach to the feet.
 2. They are strong or hard enough to walk three miles without shoes.
 3. So much tight, that they should not fall off without tie up.
Wiping on them is also permissible.
All the Ummah's leading scholars and jurists agree that it is not permissible to wipe on the thin socks in which the above characteristics are not found. Allama Kasani رحمہ اللہ said: ﻓﺈﻥ ﻛﺎﻧﺎ ﺭﻗﻴﻘﻴﻦ ﻳﺸﻔﺎﻥ اﻟﻤﺎء، ﻻ ﻳﺠﻮﺯ اﻟﻤﺴﺢﻋﻠﻴﻬﻤﺎ ﺑﺎﻹﺟﻤﺎﻉ۔(بدائع الصنائع: فصل فی المسح علی الخفین، ج:1، ص:10، ط: دارالکتب العلمیہ، بیروت۔).
Translation: "If the socks are thin and transparent that water can easily penetrate from them, then all the scholars agree that it is not permissible to wipe on them".
Renowned Arab Scholar Shaykh Ibn Baaz رحمہ اللہ said :(مجموع فتاوى ابن باز:ﺑﺎﺏ اﻟﻤﺴﺢ ﻋﻠﻰ اﻟﺨﻔﻴﻦ،اﻟﻤﺴﺢ ﻋﻠﻰ اﻟﺠﻮاﺭﺏ اﻟﺸﻔﺎﻓﺔ،ج:10، ص:110)
Translation: The condition of wiping on socks is that, socks should be thick and cover whole foot, so if socks are transparent then it is not permissible to wipe on them, because in this case the foot is under ruling of bare foot.
Therefore, wiping on woolen, cotton, and nylon socks
that did not have the characteristics mentioned above, is not correct and praying behind Imam who does wipe on such socks (woolen, cotton, and nylon) is also not correct.

دلائل:

الدر المختار: (باب المسح علی الخفین، 263/1، ط: دار الفکر)
(شرط مسحه) ثلاثة أمور: الأول (كونه ساتر) محل فرض الغسل (القدم مع الكعب) أو يكون نقصانه أقل من الخرق المانع، فيجوز على الزربول لو مشدودا....(و) الثاني (كونه مشغولا بالرجل) ليمنع سراية الحدث،....(و) الثالث (كونه مما يمكن متابعة المشي) المعتاد (فيه) فرسخا فأكثر.

البحر الرائق: (باب المسح علی الخفین، 192/1، ط: دار الکتاب الاسلامی)
(قوله: والجورب المجلد والمنعل والثخين) أي يجوز المسح على الجورب إذا كان مجلدا أو منعلا أو ثخينا يقال جورب مجلد إذا وضع الجلد على أعلاه وأسفله وجورب منعل ومنعل الذي وضع على أسفله جلدة كالنعل للقدم۔۔۔والثخين أن يقوم على الساق من غير شد ولا يسقط ولا يشف اه.
وفي التبيين ولا يرى ما تحته ثم المسح على الجورب إذا كان منعلا جائز اتفاقا، وإذا كان لم يكن منعلا، وكان رقيقا غير جائز اتفاقا، وإن كان ثخينا فهو غير جائز عند أبي حنيفة

"و" الرابع عشر من شروط صحة الاقتداء "أن لا يعلم المقتدي من حال إمامه" المخالف لمذهبه "مفسدا في زعم المأموم" يعني في مذهب المأموم "كخروج دم" سائل "أو قيء" يملأ الفم وتيقن أنه "لم يعد بعده وضوءه"
