Topic: Islamic Ruling on Termination of Pregnancy Due to Psychological Concerns

Q Please advice if it is permissible in Islam to terminate the pregnancy for the following reasons:
I was married in 2018.
My wife is pregnant of 6 weeks and 3 days by today as on 23 September 2026
I have 3 daughters, elder one is 7 years old and twin daughers are 4 years old.
I am so much concern about the upbringing of my above mentioned 3 daughter.
My wife attempted suicide after one month of the birth of twin in 2022. I can provide the documentation. My wife had couple of sessions with pcycologist as advised by GP and other athority.
That was second or third time suicide attempt that was not disclosed to GP or athority.
We had regular fights and police involved twice called by my wife on a little issue in front on my daughters.
I requested my wife to consult with psycologist to be treated but she refused.
I have attempted one divorce in 2024 (2 remaining) and separated almost 2 months, which also had the worse effect, specialy my elder daughter.
We dont have family to support here in Melbourne.
Me and my wife trying to strengthen our relation. I am taking care in house chores and other stuff such as preparing break fast for my daughters, getting them ready for school and droping them on schools while my wife is at work, which impacting my performance too at work place.
My wife work 3 days a week.
I am scared after having one more baby will impact upbringing of kids and on our relation as husband and wife and will lead to separation.
Please respond us as soon as possible on this matter.

aIt should be noted that the termination of a pregnancy is a serious matter in Islamic law and is not permissible merely due to concerns regarding the upbringing of the children, financial instability, lack of family support, or fear that the arrival of another child may negatively affect the marital relationship.
Furthermore, once 120 days of pregnancy have passed, termination of the pregnancy is not permissible.
As for the situation described in the question, termination of the pregnancy before 120 days is only permissible if a reliable medical professional determines that continuing the pregnancy would pose a serious risk to your wife's life.

وفي الذخيرة: لو أرادت إلقاء الماء بعد وصوله إلى الرحم قالوا إن مضت مدة ينفخ فيه الروح لا يباح لها وقبله اختلف المشايخ فيه والنفخ مقدر بمائة وعشرين يوما بالحديث.

مطلب في حكم إسقاط الحمل ( قوله وقالوا إلخ ) قال في النهر : بقي هل يباح الإسقاط بعد الحمل ؟ نعم يباح ما لم يتخلق منه شيء ولن يكون ذلك إلا بعد مائة وعشرين يوما ، وهذا يقتضي أنهم أرادوابالتخليق نفخ الروح وإلا فهو غلط لأن التخليق يتحقق بالمشاهدة قبل هذه المدة كذا في الفتح ، وإطلاقهم يفيد عدم توقف جواز إسقاطها قبل المدة المذكورة على إذن الزوج وفي كراهة الخانية : ولا أقول بالحل إذ المحرم لو كسر بيض الصيد ضمنه لأنه أصل الصيد فلما كان يؤاخذ بالجزاء فلا أقل من أن يلحقها إثم هنا إذا سقط بغير عذرها ا ه قال ابن وهبان : ومن الأعذار أن ينقطع لبنها بعد ظهور الحمل وليس لأبي الصبي ما يستأجر به الظئر ويخاف هلاكه ونقل عن الذخيرة لو أرادت الإلقاء قبل مضي زمن ينفخ فيه الروح هل يباح لها ذلك أم لا ؟ اختلفوا فيه ، وكان الفقيه علي بن موسى يقول : إنه يكره ، فإن الماء بعدما وقع في الرحم مآله الحياة فيكون له حكم الحياة كما في بيضة صيد الحرم ، ونحوه في الظهيرية قال ابن وهبان : فإباحة الإسقاط محمولة على حالة العذر ، أو أنها لا تأثم إثم القتل ا ه وبما في الذخيرة تبين أنهم ما أرادوا بالتحقيق إلا نفخ الروح ، وأن قاضي خان مسبوق بما مر من التفقه ، والله تعالى الموفق ا ه كلام النهر ح.

يباح لها أن تعالج في استنزال الدم ما دام نطفة أو مضغۃ أو علقة لم يخلق له عضو وخلقه لا يستبين إلا بعد مائة وعشرين يوما أربعون نطفة وأربعون علقة وأربعون مضغة كذا في خزانة المفتين.وهكذا في فتاوى قاضي خان.
