Topic: Donating the Hides of Sacrificial Animals to Welfare Organisations   (No-15901)

Q Ever since the price of hides has decreased, fewer and fewer madrassah students are coming to collect the hides of sacrificial animals. In such a situation, can we donate the hides of our sacrificial animals to organizations that will then use the money obtained from selling these hides for advertising or building roads? Does doing so impact our actual Qurbani?

aIt is important to note that the person who sacrifices the animal can choose not to sell its hide and use it for themselves, gift it to someone, or donate it to the poor and needy.
If a person decides to sell the hide, the ruling regarding the spending of the money obtained from this sale is the same as the ruling regarding the spending of Zakat and Sadaqat e Wajibah (Obligatory Sadaqat). Thus, just like it is not permissible to spend Zakat money on welfare activities such as the construction of a road, it is also not permissible to do so with the money obtained from selling the hide of a sacrificial animal.
With this in mind, if someone is fully confident that a certain organisation will strive to spend the money obtained from the sale of the hides as it should be spent, that is, donating it to the poor and needy, then they can donate their hides to that organisation. On the contrary, donating the hides of sacrificial animals to organisations which spend the money obtained from selling the hides on welfare activities such as the construction of roads, instead of donating it to the poor and needy, is not permissible.
With that being said, donating the hides of sacrificial animals to such organisations does not affect the Qurbani in itself; the obligation of Qurbani is still fulfilled.

"بیع شيء من لحمہا أو شحمہا أو صوفہا أو شعرہا أو وبرہا أو غیر ذٰلک، إذا کان البیع بدراہم أو دنانیر أو ماکولات أو نحو ذٰلک مما لا ینتفع بہ إلا باستہلاک عینہ، فہٰذا البیع لا یحل وہو مکروہ تحریمًا ،فإن باع نفذ البیع عند أبي حنیفۃ ومحمد، ووجب علیہ التصدق بثمنہ؛ لأن القربۃ ذہبت عنہ ببیعہ ولا ینفذ البیع عند أبي یوسف، فعلیہ أن یستردہ من المشتري؛ فإن لم یستطع وجب التصدق بثمنہ".

شرح العینی للھدایۃ: (190/4)
"فإذا تمولتہ بالبیع وجب التصدق؛ لأن ہٰذا الثمن حصل بفعل مکروہ فیکون خبثًا فیجب التصدق".

الدر المختار مع رد المحتار: (باب المصرف)
"ویشترط أن یکون الصرف تملیکًا لا إباحۃً کما مر لا یصرف إلی بناء نحو مسجد".
"کبناء القناطر والسقایات وإصلاح الطرقات وکری الأنہار وکل ما لا تملیک لہ".

الھدایۃ: (کتاب الوکالة، 179/3)
"ومن شرط الوکالۃ أن یکون المؤکل ممن یملک التصرف ویلزمہ الأحکام؛ لأن الوکیل یملک التصرف من جہۃ المؤکل، فلا بہ أن یکون المؤکل مالکًا لیملکہ من غیرہ".
